Terms of sale

1. The seller

These terms govern the sales of masonry services concluded on the site fondalis-construction.com by Fondalis Construction, a SASU with a share capital of 1 000 €, registered with the RCS of Vienne under number 105 041 669 (European identifier FR3802.105041669), whose registered office is at 1 rue du Boulodrome, 38300 Bourgoin-Jallieu, France.

2. Subject

The site sells general masonry jobs carried out at the site indicated by the customer, in mainland Spain. Each job is described on its page: unit of measure, price per unit by quality, services included and excluded. The site also sells the provision of a crew for 8 hours per day, materials not included.

The images on the site are synthetic images generated for the brand: they illustrate the type of work and represent neither a real site nor a guaranteed result.

3. Prices

Prices are in euros, taxes included, materials and labour. The price of a job is the unit price of the chosen quality multiplied by the quantity stated by the customer, and cannot be lower than the minimum call-out of €390. Added once per job are the travel and set-up charge according to the zone of the site (North-East: €90; Centre and North: €190; South and Extremadura: €260) and the chosen options.

The real quantity, measured on site before work starts, adjusts the balance at the unit price of the order, up or down. If this measurement reveals a difference of more than 20% from the ordered quantity, either party may withdraw from the job free of charge, and the deposit is refunded.

Published prices may change at any time; the applicable price is the one published at the time of the order. A quote generated by the site remains valid for 30 days.

4. The order

The order is placed online: configuration of the job, addition to the basket, entry of details and the site address, acceptance of these terms, then payment of the deposit on the secure payment page. The order is firm on receipt of payment.

Within 24 working hours of the order, the seller confirms the start date in writing, or proposes another date if the requested one is not available. If no date suits the customer, the order is cancelled and the deposit refunded. The seller may ask for photographs of the substrate; if they reveal a technical impossibility not covered by the job, the seller informs the customer before any travel, and the order may be cancelled free of charge.

5. Payment

At the order the customer pays a deposit of 30% of the total, or the whole amount if the total is below €600. The balance is due on handover of the work, against the report. Accepted methods: Bank card, Apple Pay and Google Pay, on a secure payment page served on the site's domain by our payment service provider; the balance may also be paid by bank transfer.

No card data is entered on the site's pages or kept by the seller. A declined payment does not bind the seller; the order is kept to allow a new attempt.

6. Performance

The crew arrives on the confirmed date, with the tools and the materials of the quality. The customer guarantees access to the site, the availability of water and electricity, and the administrative permits required for the work. A delay attributable to the customer may lead to a crew day being invoiced at the rate of €420.

The seller carries out the work in accordance with the rules of the trade and the description on the page. Any additional service requested on site is subject to prior written agreement, at the site's rates.

7. Handover and guarantee

At the end of the work, the parties sign a handover report describing the works and any reservations. The seller clears the reservations within a reasonable time, at its expense. The balance is paid at signature, minor reservations included.

The works are covered by a 2-year workmanship guarantee from handover, without prejudice to the legal guarantees applicable to building works under the law of the place of the site. Normal wear, damage caused by a third party, a reported and untreated substrate defect, or non-compliant use are excluded.

8. Cancellation and right of withdrawal

The customer may cancel free of charge up to 7 days before the confirmed start date; the deposit is then refunded within 14 days. After that, the deposit is retained by the seller for the materials ordered and the planning, unless otherwise agreed.

As a consumer, the customer also has a right of withdrawal of 14 days from the order, without giving a reason, by e-mail to contacto@fondalis-construction.com or using the form in the appendix. If the customer expressly asks for the work to start before the end of this period, they acknowledge losing their right of withdrawal once the job has been fully performed and, in case of withdrawal during performance, owe the price of the work already carried out.

The seller may cancel a job in case of force majeure or of a technical impossibility found after receiving the photographs; the deposit is then refunded in full.

9. Liability

The seller is liable for damage caused by its crews during the work, within the limits of its insurance policy. It is not liable for defects resulting from a hidden defect of the substrate, from inaccurate information supplied by the customer, or from the absence of an administrative permit.

10. Personal data

The customer's data is used to perform the order, plan the work and issue invoices. Its processing is described in the privacy policy.

11. Applicable law and disputes

These terms are governed by French law, without depriving the consumer of the mandatory provisions of the law of their habitual residence. In case of dispute, the parties first seek an amicable solution; the consumer may use a consumer mediator free of charge: [TO BE COMPLETED — consumer mediator]. Failing agreement, the competent courts are those designated by law.
